Contracts Litigation
Zuckert, Scoutt & Rasenberger
represents prime contractors, subcontractors and suppliers
in all phases of the federal procurement and contracting
process. We serve clients in such diverse industries as
equipment manufacturing, construction, advertising, ocean
shipping, personal goods moving, and computer software.
While a good deal of the Government Contracts practice
deals with negotiation and drafting of bids and contracts,
creation of joint ventures, and contract finance and
administration, dispute resolution also plays an important
role. We regularly prosecute contract claims before the
applicable agencies, before boards of contract appeals and
before the Court of Federal Claims. Zuckert, Scoutt &
Rasenberger attorneys also represent clients in bid protest
proceedings. Recently we have handled the following public
contracts disputes:
- We are representing an aircraft and aerostructures
manufacturer in a multi-million dollar contract claim
against the United States Army with respect to cost
overruns on an aircraft remanufacturing contract.
- We represented a manufacturer of high pressure air
compressors in a bid protest at the General Accounting
Office challenging an award of a contract for such
compressors for a class of United States Navy vessels.
- We defended a security systems manufacturing firm in
litigation at the U.S. Court of Federal Claims
regarding a defective pricing claim brought by the
General Services Administration.
- We defended a contractor that provides military base
maintenance and support services against civil and
criminal false claims charges based on alleged
irregularities in preventive maintenance inspections.
- We intervened in a protest action on behalf of a
merchant marine seaman’s union in defense of a Navy
contract award for large naval cargo ships to be manned
by the merchant marine.
- We represented a household goods move management firm
in a bid protest at the U.S. Court of Federal Claims
challenging the awards in a pilot U.S. Department of
Defense program for military service household goods
moves.
- We represented a charter airline in claims against
one of the military services for damage caused to the
airline's aircraft by fallout from a volcanic eruption
during military airlift program operations.
The U.S. Government has become increasingly aggressive
in investigating and prosecuting fraudulent and other
wrongful practices by contractors. Federal authorities are
placing greater emphasis upon voluntary disclosure programs
and are holding contractors to much higher standards of
internal training and policing with respect to crime
prevention and detection. In response to these
developments, Zuckert, Scoutt & Rasenberger attorneys
have worked with contractor clients to establish or improve
existing programs for prevention of criminal conduct. Our
litigation and government contracts attorneys have
conducted internal crime investigations for clients, and we
have represented clients subject to Grand Jury
investigation or investigation by the agencies themselves.
