  • Contract Terminations

We have represented clients confronted with both terminations for convenience and terminations for default under government contracts.

  • We assisted a major subcontractor in recovering performance and close-out costs following the termination for convenience of a NASA space launch facilities project due to budget limitations.
  • We represented a specialized equipment manufacturer whose contract was terminated for default by the Federal Aviation Administration; the matter was ultimately settled as a no-fault contract termination.
  • We provided advice on numerous contract close-out issues following the partial termination for convenience of an equipment manufacturer serving as a principal subcontractor on a Department of Energy nuclear weapons project; a final settlement satisfactory to our client was reached with DOE and the prime contractor.
  • We represented a manufacturer of portable military equipment camouflage structures in connection with a threatened Air Force termination for default based on alleged failure of the structures to meet the assembly time requirements of the contract specifications.
  • We successfully contested a termination for default of an Army contract for the manufacture and supply of electric multimeters, demonstrating that a high failure rate in drop tests resulted from deficient Army specifications rather than from any manufacturing deficiency or mistake.
  • We obtained a termination for convenience for a client facing a threatened termination for default on a GSA contract for the supply of self-adhesive note pads, having shown that quality problems were the result of deficiencies in the government specifications rather than manufacturing deficiencies.
