  • Labor and Employment Matters

We regularly advise our clients with government contracts on labor and employment issues unique to federal contracting, including questions arising under the Service Contract Act and the Davis-Bacon Act. We also have worked with clients on labor issues involving the interplay between federal and state law. For example:

  • We advised a military base operating services contractor regarding the impact upon collective bargaining negotiations with its employees of changes in policy at the U.S. Department of Labor with respect to collectively bargained wage increases made contingent upon adoption by DOL in wage determinations.

  • We advised a nationwide delivery and logistics services provider new to government contracting regarding the scope and flow-down requirements of the Service Contract Act.

  • We obtained dismissal of claims based upon the State of California's wage and hour laws that were brought against a federal contractor by its employees working at a Naval Air Station in California, based on our theory that the state had ceded its authority over the facility to the federal government and thus had no jurisdiction to enforce its employment laws there.
  • We have advised clients bidding for Government contracts and clients with existing contracts on the potential legal ramifications flowing from reductions in force and employment "downsizing."
