We have substantial experience dealing with the intersection of bankruptcy and government contracts. We have advised government contracts clients contemplating or otherwise facing bankruptcy proceedings regarding the implications of such proceedings for their government contracts. We have acted as counsel to debtors-in-possession with respect to government contracts claims and issues. We have acted as special counsel to bankruptcy trustees in matters relating to government contracts. We have represented subcontractors faced with the bankruptcy of prime contractors. Examples include the following:

  • We defended a debtor-in-possession manufacturing company against efforts by the Air Force to attach corporate assets in connection with the termination for default of a supply contract for fire-fighting equipment.

  • We represented a government contractor that went into bankruptcy during the pendency of litigation of a dispute with the U.S. Army regarding its attempted termination for default of a contract for the supply of certain electrical testing equipment.

  • We represented a subcontractor in asserting the claims of a bankrupt prime contractor for payment under a federal agency contract for supply of protective coverings for transport vehicles.
