The firm handles a wide variety of aviation-related claims and litigation for its clients.  For example, the firm represented a major U.S. air carrier in an action against a manufacturer for return of progress payments made by the carrier toward the purchase of certain aircraft under purchase options.  The firm also recently advised the trustee of an equipment trust in connection with a dispute over the return condition of certain aircraft which were the subject of an operating lease.

  • Regulatory and Administrative

The members of Zuckert, Scoutt & Rasenberger regularly appear before a variety of federal administrative agencies having jurisdiction over aviation matters.  

The firm handles all forms of licensing matters for U.S. and foreign clients before the U.S. Department of Transportation, the Federal Aviation Administration, the Department of Treasury and the Department of State.  In connection with counsel for other merger parties, the firm obtained approval for one of the largest mergers in the history of U.S. aviation, and regularly advises clients on matters involving acquisition of control of air carriers in compliance with the citizenship and control requirements of the Federal Aviation Act.  The firm also handles a variety of complaint and enforcement matters before the Department of Transportation and the Federal Aviation Administration.

The firm regularly advises clients on ways in which to structure their transactions to satisfy the citizenship and control requirements of the Federal Aviation Act and Exon-Florio amendments.  Recent transactions in which the firm has been involved include US Airways' sale of stock to British Airways and the purchase of stock in Continental Airlines by Air Canada and Air Partners.  

The firm also frequently serves as special counsel in matters involving the registration of aircraft and the recordation of security interests in aircraft with the Federal Aviation Administration.  It also is advising clients on important issues of topical concern, such as the debate over aging aircraft and Stage 3 noise requirements and FAA policy of wet leases and slot transfers.
