Assist with type certification ("TC) and supplemental type certification ("STC") of aviation products with civil aviation authorities such as the FAA and European Joint Aviation Authorities ("JAA"). Deal with questions involving repair stations, foreign repair stations, parts manufacturing ("PMAs") and Technical Standards Orders ("TSOs"). Advise on compliance with both U.S. and foreign law in business transactions involving one or more of the above areas. One of the more unique areas of our practice concerns the legal issues arising from construction near an airport. The Federal Aviation Administration requires notice of any construction or alteration of an existing facility that might impede on the theoretical three-dimensional boundaries of an airport. The subsequent review process is critical to local zoning and related decisions. The firm’s attorneys have been involved in a number of these matters, and successfully prosecuted the leading case limiting the authority of the Federal Aviation Administration to make a Part 77 "hazard" determination. D&F Alfonso Realty Trust v. Garvey, 216 F.3d 1191 (D.C. Cir. 2000).
Assist with all elements of air carrier certification under Federal Aviation Regulations ("FARs") Parts 121 and 135, and foreign air carrier certification under FAR 129. Provide legal advice for all activities conducted under other operating rules, including such areas as non-air carrier operations (FAR 91) rotorcraft, parachuting and balloons. Represent holders of FAA and foreign airman certificates in all matters dealing with civil aviation authorities. Advise on operational considerations arising out of aircraft leasing, time share, and other commercial arrangements. Assist in obtaining flight school certification.
Provide legal assistance in all matters pertaining to FAA and international aviation security issues. Includes advice on airport and operation security plans, as well as compliance assessment. Advise clients on airport and aircraft physical security requirements and threat assessment. |
