SURFACE TRANSPORTATION BOARD
REJECTS On January 31, 2008, the Surface Transportation Board resolved a dispute concerning the extent of the rail system of ZS&R client, Norfolk Southern Railway Company (NSR). In 1998, the STB approved a transaction by which NSR and CSX Transportation Company acquired and divided between them the rail lines of Conrail, leaving certain lines to be shared by both (called Shared Assets Areas). In January, 2006, Bridgewater Resources, Inc., operator of a waste transfer facility in New Jersey that had received rail service from NSR since 1998, petitioned the STB to declare that BRI’s facility was not on a line that had been allocated exclusively to NSR but was instead within the North Jersey Shared Assets Area. BRI, NSR and CSX submitted extensive evidence on the intent of the parties to the Conrail transaction concerning the boundaries of the NSR and CSXT systems and the Shared Assets Areas in New Jersey. In its January 31, 2008 decision, the STB found that BRI had not sustained its claim that its facility was not on an NSR line. ZS&R partner Richard Allen represented NSR in this matter.
ZSR’s Aviation Advisor ZS&R publishes the Aviation Advisor, the firm’s real time report on aviation-related legal developments. Some of the editions published since September 11, 2001, are available on this site by clicking below:
